  • a white headlight visible from at least 500 feet
  • a red rear reflector visible from 50 to 300 feet

  • Ride on the right - Always ride with the flow of traffic. Riding against traffic is dangerous and could result in severe injury or catastrophic injury.
  • Ride predictably - Follow the same rules motorists do, and travel in a straight line without swerving.
  • Obey traffic control devices (signs, signals, bike lane markings) - Cyclist(s) must follow the rules of the road like other vehicles.
  • Protect your head - Always wear a helmet, even on the shortest trips.
  • Follow lane markings - Don't turn left from the right lane. Don't ride straight in a lane marked Right-Turn Only.
  • Ride correctly through intersections - Use the right-most lane that goes in your direction. If you're heading straight, get in the through lane, not to the right of a right-turning vehicle.
  • Signal before you move or stop - Hand signals let drivers and others know what you intend to do.
  • Enter streets and intersections cautiously - Always check for oncoming traffic.
  • Ride defensively on the road - Anticipate hazards and be ready to adjust your position in traffic.
  • Don't ride on the sidewalk - Many people consider sidewalks a safe place to ride because cars don't travel on them. Unfortunately, sidewalks aren't safe. Stay off them, except where you have no choice. Trees, hedges, parked cars, buildings, and doorways create blindspots along a sidewalk, which is too narrow to allow you to swerve out of the way if someone appears. A pedestrian on the sidewalk can sidestep suddenly, or a small child can run out from behind an adult. Never pass a pedestrian until you have his or her attention. And cars do use sidewalks - at every driveway and cross-street. Since there are no clear rules for travel on a sidewalk, your only choice is to ride very slowly and look in all directions before crossing a driveway or street
  • Be visible and be seen - Wear bright colors to increase your visibility and make eye contact with drivers.
  • Look behind you - Know how to look over your shoulder and not swerve or lose balance. Rear-view mirrors are an option.

Dog Bites

In Arizona, the dog’s owner is held responsible for the first bite, no matter the breed. Some common questions include whether a dog gets “one free bite”, whether the dog’s breed matters, or whether the owner had knowledge the dog would bite.  In Arizona, the answer to all three questions is “no.” Arizona law provides “[t]he owner of a dog which bites a person when the person is in or on a public place or lawfully in or on a private place, including the property of the owner of the dog, is liable for damages suffered by the person bitten, regardless of the former viciousness of the dog or the owner’s knowledge of its viciousness.” Arizona Revised Statute 11-1025 (A).  

This type of law is known as ‘strict liability’ meaning the owner’s knowledge or mental state plays no role in deciding his liability (legal responsibility). Thus, if a dog injured you with a bite, it does not matter that the dog never bit anyone before, it does not matter the dog’s breed, and the owner’s knowledge does not matter either. Now, if the owner intentionally made the dog bite you, that is a whole different scenario of intentional torts.

Here, with the common dog bite, the owner will most likely be held responsible for your injury and you should discuss your legal options with an attorney who regularly handles personal injury cases.

In Arizona, the dog owner will not be responsible if the injured person was trespassing or In Arizona, the only defense to a dog bite is that the injured person trespassed, or provoked the dog. The statute discussed above requires the person to be in a “public place or lawfully in or on a private place”. Thus, if you are not lawfully allowed to be where you were bitten, ie trespassing, the dog owner has a valid defense. Arizona law also provides “[p]roof of provocation of the attack by the person injured shall be a defense to the action for damages.”

Arizona Revised Statute 11-1027. Here, the court system determined that the “common law defenses of contributory negligence and assumption of risk superseded.” Massey v. Colaric, 151 Ariz. 65, 725 P.2d 1099 (1986). This means the dog owner cannot argue that the injured person assumed the risk such as coming towards the dog or offering a hand to the dog. The only valid defenses are if the injured person was trespassing or if the dog owner can prove that the injured person provoked the dog. In Arizona, the bite victim has one year to file a lawsuit or settle a claim.

Another question is how much time an injured person has to hold the dog owner responsible. Arizona law provides, “[t]here shall be commenced and prosecuted within one year after the cause of action accrues, and not afterward, the following actions… (5) Upon a liability created by statute. Arizona Revised Statute 12-541. Dog bite liability falls under this time limitation. Thus, an injured person has one year from the day of the bite to either file a lawsuit or settle a claim.

Joseph Brown

Joseph Brown currently serves on the Phoenix Dance Cooperative Board of Directors as well as the Ahwatukee YMCA (since 2010). He is also a passionate supporter of various organizations including Phoenix Children’s Hospital, St. Mary’s Food Bank, Phoenix Rescue Mission, Goodwill and more.

Joseph is very passionate about supporting youth in the community he lives in which includes sponsoring various athletic clubs at Desert Vista High School and other East Valley schools.

The Phoenix Dance Cooperative is a structured, not-for-profit organization founded by parents of dancers. The driving force behind the organization is to provide high quality dance instruction with a focus on competition as a group, while fostering a loving environment with a strong sense of community.

The YMCA is one of the oldest and largest non-profits in Arizona. Through its many initiatives, programs, and services, the Y helps youth realize their potential; teens and young adults prepare for college; families spend time and have fun together; people are healthier in mind, body, and spirit; job seekers prepare for employment; newcomers are welcome and embraced; a nationwide service ethic is fostered; and so much more.

Carl Engstrand has been donating blood regularly since 2007. One blood donation can save up to three lives. Blood is always in demand and so simple to give. Pedestrian Highway Accidents: Injured When Walking



Did you know that somewhere around 70,000 pedestrians lose their lives every year in crashes across the U.S.? In Arizona, we care about the safety of pedestrians and realize that they are prone to accidents due to the negligence of other drivers. In fact, research shows us that Arizona pedestrians are some of the most likely people to die in crashes that lead to fatalities. In fact, you are at least twice as likely to end up in a fatal accident than in 30 other states! These accidents happen when crossing streets, walking along busy highways, and more. With so many accidents happening in our state, we want to alert you to the real dangers of our highways and the fact that, if you are a pedestrian who walks along a highway, you have increased risks of a catastrophic accident at any given time.
When a pedestrian causes their own accident, it is usually due to ‘darting out,’ which means running out in front of a vehicle very suddenly. This usually happens when they popped out from behind an unseen area, like a driveway or from behind another car parked alongside the road. The biggest perpetrators of these incidents are usually children, who do not always remember to look before crossing the street. Pedestrians are also prone to jaywalking in certain areas, which means that the pedestrian could be held partially liable for the accident when they have made an illegal move. What about when a pedestrian walks along the highway and an accident occurs?

Pedestrians have the right to walk anywhere they want to, if it isn’t for extended periods of time on the road. This is why, any time a pedestrian is injured walking alongside a road (no matter what type), a driver could be liable for injuries. In most states, pedestrians are legally allowed to walk alongside the highway as long as they are far from the edge of the roadway. Cars on the highway are known to speed more than usual and weave in and out of traffic, which is why these accidents tend to be more common than others. This is why pedestrians need to be extra cautious when it comes to these roads because highways are definitely more dangerous in nature.
