Bicycle Accident Lawyer | Have you been in a bicycle accident?

Bikers safely biking on the road

Bicycle accident victims oftentimes get the worse types of injuries. In fact, some can even be fatal. If you are a victim of a bicycle accident or have a friend or loved one who have figured in said accident, contact Accident Law Group. We are the only law firm that specializes in providing the best legal representation for victims of bicycle accidents.

Bicycles are becoming an increasingly popular mode of transportation, and many local areas are increasing bike lanes and trying to improve safety for bicycle riders. Unfortunately, many motorists still do not know how to share the road with bike riders, and drivers who make mistakes or who are careless could cause a bicyclist to sustain life-altering injuries. When a driver causes a bicycle accident and serious injuries or death result from the crash, the motorist who was responsible needs to compensate the victim. The victim, however, has the burden of taking legal action and pursuing a damage claim. This can be challenging, especially when you are coping with serious injuries or if your loved one has been killed in a bike accident and you are dealing with grief.

The best way to protect your rights after a bicycle accident in Arizona is to get help from an experienced bicycle accident attorney. Our attorneys are here and ready to help you to pursue a bike accident claim. At Accident Law Group, our legal team is comprised of some of the best bicycle accident attorneys Arizona has available. As such, we’ll work with you every step of the way, providing the guidance you need to navigate the insurance process and win your lawsuit.

Bicycle Rider Safety

Arizona Department of Transportation Active Transportation Program has a Bicycling Safety Program

Below are some key highlights:

If You Ride at Night Arizona Bike Law/Bicycle Law/Traffic Law requires those riding a bike to have:

  • a white headlight visible from at least 500 feet
  • a red rear reflector visible from 50 to 300 feet

A cyclist may also have a red tail light visible from 500 feet (blinking tail lights are eye-catching). You may want to consider wearing a reflective vest or reflective tape on your helmet or clothes.

Bike Smart, Bicycle Safety

To be safe and avoid a cycling accident or a bike crash, bicyclists should ride with traffic and be aware of hazards, cars, and people around them. Bike smart and follow these safety tips for biking in Arizona:

  • Ride on the right - Always ride with the flow of traffic. Riding against traffic is dangerous and could result in severe injury or catastrophic injury.
  • Ride predictably - Follow the same rules motorists do, and travel in a straight line without swerving.
  • Obey traffic control devices (signs, signals, bike lane markings) - Cyclist(s) must follow the rules of the road like other vehicles.
  • Protect your head - Always wear a helmet, even on the shortest trips.
  • Follow lane markings - Don't turn left from the right lane. Don't ride straight in a lane marked Right-Turn Only.
  • Ride correctly through intersections - Use the right-most lane that goes in your direction. If you're heading straight, get in the through lane, not to the right of a right-turning vehicle.
  • Signal before you move or stop - Hand signals let drivers and others know what you intend to do.
  • Enter streets and intersections cautiously - Always check for oncoming traffic.
  • Ride defensively on the road - Anticipate hazards and be ready to adjust your position in traffic.
  • Don't ride on the sidewalk - Many people consider sidewalks a safe place to ride because cars don't travel on them. Unfortunately, sidewalks aren't safe. Stay off them, except where you have no choice. Trees, hedges, parked cars, buildings, and doorways create blindspots along a sidewalk, which is too narrow to allow you to swerve out of the way if someone appears. A pedestrian on the sidewalk can sidestep suddenly, or a small child can run out from behind an adult. Never pass a pedestrian until you have his or her attention. And cars do use sidewalks - at every driveway and cross-street. Since there are no clear rules for travel on a sidewalk, your only choice is to ride very slowly and look in all directions before crossing a driveway or street
  • Be visible and be seen - Wear bright colors to increase your visibility and make eye contact with drivers.
  • Look behind you - Know how to look over your shoulder and not swerve or lose balance. Rear-view mirrors are an option.
  • Learn more about Avoiding Motor Vehicle(s)(link is external)
  • Everything on your bike should be properly adjusted and in good working condition. Keep a well-maintained bike, be a smart bike rider, and conduct the ABC Quick Check(link is external) before you ride as recommended by the League of American Bicyclists.

Arizona Bicycling Organizations, Clubs, and Programs

Many Arizona Cities and Counties have bicycle programs that promote bicycle transportation and safety. These programs typically coordinate a bicycle planning process for a city or region and identify policies and priorities for investing in local a bicycle system. They can provide specific information on bicycling in your area, including existing and planned trails and bikeways.

Wet Floor Sign: Why Proper Signs Are Important

Wet Floor Sign:

If you know one thing about businesses and premises liability law, it’s that a property owner could be held liable for your accident if they do not keep their property safe from all harm. The same can be said for stores, which are supposed to be free from all harm because of the many people who utilize their property every day so that they can obtain the goods that mean the most to them. When you walk into an establishment and there are slippery floors, you, like every other American, expects to see Wet Floor signs to warn people that there is a slippery condition there. But what happens when there are no signs and you slip and fall in this condition, gaining a serious injury? You may wonder if you can hold a store liable for not warning you about the condition.

Why Proper Wet Floor Signs Are So Important

Commercial establishments owe a duty of care to those who utilize their store. This means that they should protect them from harm in many ways, such as stairways that need rail adjustments or when there is loose carpet on the floor that somebody could trip over. Part of this duty of care includes using wet floor signs, which show that the area around there is slippery. Perhaps this is due to the fact that somebody just spilled something and they are waiting for an employee to clean the floor, or because they have just mopped all the floors in the store and there is one section just waiting to dry.

However, there is one exception to this rule.

What happens if the spill just happened and nobody said anything to an employee about it? If the spill just happened and a person standing right there came and slipped on it, then the store might not be liable because they didn’t have enough time to figure out that anything was wrong. Sometimes, when employees or management didn’t have enough time to discover the condition, the same liability rules would not apply. However, if the spill was there for many hours already, then there is a reason to believe that the employees had enough time to discover that something was wrong on that part of the floor.

What if somebody saw multiple employees stepping around that area, clearly noticing the adverse condition on the floors, but still failed to put down wet floor signs to signal that there was a condition that could cause them harm? If you had evidence of this, you could hold the store liable for your injuries because they failed to act. It is not uncommon to suffer from a variety of injuries in these cases such as sprained and bruised muscles or ligaments, whiplash, fractured bones, head injuries, and more.

How We Can Help

We can help you from beginning to end when it comes to the claim you bring against a company for their negligence. Struck by Hazards in Construction: A Very Real Hazard

Struck by Hazards in Construction: A Very Real Hazard

In the construction industry, there are some types of accidents that are more common than others, causing more deaths than any other type of accident. These are known as “construction’s fatal fours” and eliminating these accidents would save the lives of 602 workers in America every year. These include falls, electrocutions, and caught in-between accidents… and struck by falling objects. Today we want to focus on accidents that happen when an employee is struck by an object, how deadly these accidents can be, and what can be done within the construction industry to change this.

Accidents: Learn the Statistics

Each year, many workers die from struck-by accidents. In the year 2007, for instance, there were a total of 504 struck-by cases, with 311 deaths happening. Approximately 26% of the deaths that occur in construction happen due to these specific accidents. One of the main risk factors of these accidents is working or walking below an elevated work surface, which could make you more prone to being hit by falling objects.
OSHA reports that there are about 50,000 struck by falling objects incidents reported in a variety of industries every year, which means that there is one injury caused by a falling object every 10 minutes! Despite the statistics and the fact that proper safety equipment could have prevented a wide variety of the injuries and deaths stemming from these accidents, contractors and companies tend to ignore the fact that these accidents are happening and the numbers continue to rise.

Injuries: How These Accidents Can Be Prevented

OSHA and a variety of workplaces recommend and require their employees to use fall protection equipment for tools. Here are the rules they recommend following:
  • There should always be lanyards and wristbands to safely hold onto equipment and they should be set in a way that allows you to use the tool without issue
  • You should never have to modify the a tool to effectively attach a protective system to it
  • Tools over 5 pounds should be attached to a fixed structure and used with a tether
OSHA says that tools should always be secured no matter what, and that hazard warning signs should be posted around a site so that people do not walk unexpectedly in a dangerous area. In some cases, workplaces use debris nets and catch platforms to deflect falling objects if they happen to fall anyway.

When You Have Been Injured

There are many reasons why these accidents happen, even if some can be prevented. Sometimes, a worker could make a simple mistake because of a careless error, or because they were lacking proper training. Perhaps a contractor improperly set up protective equipment meant to catch objects when they fall. No matter what, if safety rules were not abided by and you were struck with an object, you may have sustained serious injuries. You could suffer concussions, brain injuries, neck and back injuries, and even paralysis from being hit by an object. You may be entitled to workers’ compensation benefits or be able to make a claim against a third party if your employer was not responsible for your injuries. Call us at the Accident Law Group if you have been injured by a falling object in the construction workplace and need help with your case. We are waiting to hear from you today, so give us a call at 602-262-4254.

A Better Understanding of the Personal Injury Settlement Process

A Better Understanding of the Personal Injury Settlement Process
When you first become injured in a car accident, the two things you may be thinking of are this: “I need to receive medical treatment” and “I need to talk to a lawyer.” Most people automatically assume that they will be pursuing personal injury damages in court, but the truth is, only up to 5% of personal injury claims ever see the inside of a courtroom. Why? Because many cases stop at the personal injury settlement process.

The Basics of Personal Injury Settlement

Settlement is the decision process many people make in car accident injury cases when they would rather not have their case settled by a judge or jury. This means the defendant, or the person who was responsible for the accident, will offer a certain sum of money to the plaintiff. However, then you must sign a release that says that you will not take these matters to court. Settlement sometimes doesn’t start at the beginning of the case. Sometimes, settlement takes place in the middle of litigation, when two parties decide that it’s best to settle instead of leave the fate of their case in the hands of a jury.

Many people think that, in choosing settlement, they will not get the outcome they were hoping for, but this is not always the case. Here are some of the benefits to settlement:

Expense: You will find that the litigation process is packed with expenses. This includes paying for attorneys, expert witnesses, the discovery process, traveling to and from, and so much more. You can reduce these expenses when you choose to go through settlement instead.

Stress: You may discover that many parts of the trial process are difficult and stressful. This includes anticipation as you await results, cross-examination, and many other aspects.

Privacy: When a case goes to trial, court documents become public record, which means that anybody can access them. If you want your matters to stay as private as possible, you want to choose settlement. Most settlements use what is called a “confidentiality clause,” which will keep your matters safe between you and the other party.

When You Will Receive the Money

You may receive compensation for things like past and future medical expenses, future lost wages, loss of earning capacity, property damage, physical pain, emotional suffering, and so much more when you have been injured in a devastating car accident. Before you receive your settlement income, you want to reach maximum medical recovery, which means that you have recovered to the extent you are able to physically recover from. We will work to progress your case as quickly as possible to ensure that you can move on with your life.

At the Accident Law Group, we want to help you receive the compensation you deserve in your time of need. If you have been injured in a car accident, you may wonder: Should I choose litigation or settlement? The choice is up to you. Call us today at 602-262-4254 for more
